Cyclist damages your car and is his fault... who pays and how

Hi Everyone,

This has crossed my mind, several times when I see cyclists doing dangerous things.

Which could cause damage to your car and would be completely the cyclist fault.

So say he caused £750 damage, a few bad scratches, and a dent.

What happens next??

If a car had caused the same damage, then they are responsible, insurance, reg number etc.

This is not about the rights and wrongs of drivers and cyclists.

They are possibly insured through house insurance. If it was their fault then they are responsible for the restitution.

Take them to the Small Claims Court. If you can get their details, few cyclists are insured.

Legally they are responsible.

The harder issue might be getting them to pay as it is harder to trace a cyclist.

The CTC membership includes cycle insurance that covers third party liability. In addition it lobbies on behalf of cyclists to get more facilities and more recognition. Personally I would like to see anyone that road rides more than a few hundred metres join up. Sadly it does not cover off road which is where you will find me 99.999999999999% of the time.

I've been driving for 35 years during which time my paintwork and safety have been put in danger by all sorts of other vehicles and inanimate objects, but I've never worried about being hit by a bicycle and, needless to say, it's never happened. Compulsory insurance for cyclists is a popular rallying cry for Jeremy Clarkson and his mates, but the reality is that shopping trolleys and drunks/yobbos with keys pose a far, far greater risk to your paintwork.

However, the answer to the question is as previously given, i.e. wait until the cyclist is out of hospital and then launch a civil claim for the cost of repairing the dents they've left in your bumper with their head.
